Terms of Use

1. Acceptance of these terms
These Terms of Use govern your use of https://www.midwaychevyco.com (the "Site"), operated by Midway Chevrolet Company 1 LLC dba Midway Chevrolet ("Midway Chevrolet," "we," "us" or "our"), 2323 W Bell Road, Phoenix, AZ 85023. By using the Site you agree to these terms. If you do not agree, please do not use the Site.
2. Vehicle information, pricing and offers
Vehicle descriptions, specifications, photos and offers on the Site are general information, not an offer to sell. Photos may show optional equipment, upfits or a different trim and may not show the vehicle available at the dealership. Prices, availability, fleet incentives and offers are subject to change without notice, may require eligibility (for example a valid fleet account or business documentation) and, unless stated otherwise, exclude taxes, title, license, registration and dealer fees. Please confirm all details with a Midway Chevrolet representative before you buy. Financing and leasing are subject to credit approval by the lender.
3. Trademarks
Chevrolet, the Chevrolet Bowtie, Silverado, Colorado, Express and GM Fleet are trademarks of General Motors LLC. Midway Chevrolet is an independently owned and operated Chevrolet dealer. Other names and marks belong to their owners.
4. Acceptable use
You agree not to misuse the Site, including by submitting false information, attempting to gain unauthorized access, interfering with its operation, or using automated tools to send messages through our forms.
5. Communications
When you send us a message, you agree that we may reply by email or telephone about your request. We send text messages only to people who have agreed to receive them, as described in section 7.
6. Privacy
Our Privacy Policy explains how we collect, use and protect personal information, and is part of these terms.
7. Text Messaging Terms
Program. Midway Chevrolet Text Messaging is the text message program of Midway Chevrolet Company 1 LLC dba Midway Chevrolet. It has two parts, each with its own consent:
- Customer care messages: replies to your inquiries, quote and order updates, vehicle delivery coordination, and service appointment reminders and status updates, including two-way conversations with our team.
- Marketing messages: commercial vehicle offers, fleet incentives, new inventory alerts and dealership events. These are recurring automated marketing messages.
How to opt in. On our contact form, enter your mobile number and check one or both of the optional boxes. The boxes are unchecked by default, and the form can be sent without checking either. The wording next to each box is:

Yes, text me offers and promotions. By checking this box, I agree to receive recurring automated marketing text messages from Midway Chevrolet at the mobile number above, such as commercial vehicle offers, fleet incentives, new inventory alerts and dealership events. Up to 4 messages per month. Message and data rates may apply. Reply HELP for help or STOP to opt out at any time. Consent is not a condition of purchase.
Consent to receive text messages is not a condition of any purchase or service.
Message frequency. Customer care messages vary with your inquiry, order or service visit. Marketing messages are sent no more than 4 times per month.
Cost. Message and data rates may apply. Check your mobile plan for details.
How to opt out. Reply STOP to any message to stop all text messages from us. You may also reply STOPALL, UNSUBSCRIBE, CANCEL, END or QUIT. You will receive one message confirming that you have been unsubscribed, and no further messages after that. To stop only marketing messages and keep customer care messages, call us at 855-971-8351. To rejoin after opting out, reply START.
Help. Reply HELP to any message for help, or call us at 855-971-8351.
Carriers. Mobile carriers are not liable for delayed or undelivered messages. Message delivery is not guaranteed.
Eligibility. You must be at least 18 years old and the account holder of the mobile number, or have the account holder's permission, to enroll. Tell us promptly if you change or give up your mobile number.
Privacy. We do not sell, rent or share your mobile number or text messaging consent with third parties or affiliates for their marketing or promotional purposes. See our Privacy Policy.
Changes. We may change these Text Messaging Terms. If we make a material change to the program we will tell enrolled customers by text message.
8. Disclaimers
The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties about the Site, express or implied, including warranties of accuracy, merchantability and fitness for a particular purpose. Vehicle warranties are provided only by the manufacturer or as stated in your purchase documents.
9. Limitation of liability
To the fullest extent permitted by law, Midway Chevrolet Company 1 LLC will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or our text messaging program.
10. Governing law
These terms are governed by the laws of the State of Arizona. Any dispute will be heard in the state or federal courts located in Maricopa County, Arizona.
11. Changes to these terms
We may update these terms from time to time. The effective date above shows when they last changed.
